Overview

Understanding Temporary Resident Visas in Canada

Temporary Resident Visas (TRVs) allow foreign nationals to enter and stay in Canada for a limited period. Whether you're visiting family, pursuing education, or seeking employment opportunities, understanding the requirements and application process is essential for a successful outcome.

Canada offers several categories of temporary residence, each with specific eligibility criteria and documentation requirements. Visitor visas are for those wishing to tour Canada or visit family and friends. Study permits allow international students to pursue education at designated learning institutions. Work permits enable foreign workers to take employment with Canadian employers.

Frequently Asked Questions

How long can I stay in Canada on a visitor visa?

Most visitors are authorized to stay in Canada for up to 6 months. The border officer at the port of entry determines your authorized stay. If you need to stay longer, you must apply for a visitor record extension before your status expires. Some visitors from visa-exempt countries may enter with an Electronic Travel Authorization (eTA) instead of a visitor visa.

Can I work while on a study permit in Canada?

Yes, most study permit holders can work up to 20 hours per week during regular academic sessions and full-time during scheduled breaks. This on-campus and off-campus work authorization is typically included in your study permit conditions. You may also be eligible for a co-op or internship work permit if your program requires practical work experience.

What is the difference between an open work permit and an employer-specific work permit?

An employer-specific work permit restricts you to working for a single employer at a specific location and position. An open work permit allows you to work for almost any employer in Canada without these restrictions. Open work permits are available in specific situations, such as for spouses of skilled workers, international students graduating from Canadian institutions, or certain vulnerable worker categories.

My temporary visa application was refused. What are my options?

If your application is refused, you have several options. You can submit a new application addressing the reasons for refusal with additional supporting documentation. You may also request your file through Access to Information to understand the officer's concerns. In some cases, you may be eligible to request judicial review at the Federal Court within 15 days of receiving the refusal.

How long does it take to process a work permit application?

Processing times vary significantly depending on the type of work permit and where you apply from. Applications from within Canada typically take 2-4 months. Applications from abroad can range from a few weeks to several months depending on the visa office. LMIA-based work permits may take longer due to the Labour Market Impact Assessment process, which can add 2-3 months to the timeline.
