An immigration consultant's error may be a claim.

Sinclair Centre LawVancouver · British Columbia

We assess negligence, suspected fraud, or other dishonest conduct: what the consultant agreed to do, what happened, the loss it caused, and the applicable deadline. The first consultation is free, and a contingency arrangement may be available for a qualifying claim.

A civil claim, not a new immigration application

This service assesses whether a consultant's conduct caused recoverable loss and whether a civil claim may be available. It does not prepare a new immigration application or replace advice about an appeal, judicial review, or restoring status. Those immigration-law needs can be assessed separately.

Situations we assess

  • A missed deadline, incorrect filing, or submission made without informed authorization
  • Suspected fraud or other dishonest conduct, including material information withheld, documents altered or fabricated, or qualifications misrepresented
  • Fees paid for promised work that was not completed, or a file that was abandoned
  • A refusal, loss of status, removal consequences, lost opportunity, or financial loss connected to the conduct
  • Conduct by a licensed or unlicensed consultant retained or operating in British Columbia

Questions about a potential claim

Could I have a claim against an immigration consultant?

A claim may be available where the consultant's work fell below the required standard, or potentially involved dishonest conduct, and that conduct caused a measurable loss. The agreement, evidence, causation, limitation period, and realistic recovery all require assessment.

What records should I preserve?

Keep the retainer or agreement, payment records, applications and supporting documents, messages, decision letters, notices, and a dated chronology. Do not alter the originals.

What if the consultant was unlicensed?

Conduct by both licensed and unlicensed consultants can raise legal issues. Identifying the person, business, location, available insurance, and practical source of recovery is part of the initial assessment.

What if I now live outside Canada?

Living elsewhere does not automatically prevent an assessment when the consultant was retained or operated in British Columbia. Jurisdiction, service, evidence, deadlines, and enforcement remain fact-specific.

Is a complaint or the compensation fund the same as suing?

No. A complaint, a possible refund or fund payment, and a civil claim serve different purposes and have different conditions. None should be assumed to protect an immigration deadline or pause the time to sue.

What if I thought the consultant was a lawyer?

Send the name, agreement and any licence details. We check the person’s actual professional status and explain the appropriate route. You do not need to know the legal label before contacting us.
